Buganda Road Court Further Remands Dr. Nyanzi

Kampala. Buganda Road Court on April 25, 2017 further remanded Makerere University research fellow Dr Stella Nyanzi to Luzira prison pending an application in which Nyanzi is seeking revision of the proceedings against her at Buganda Road Court.

High Court Judge, Hon. Lady Justice Elizabeth Kabanda is expected to hear the application today ( April 26, 2017).

In her affidavit, Dr. Nyanzi noted that the State's purported application under the Mental Treatment Act is frivolous, vexatious and amounts to abuse of court processes.

The case was adjourned to May 10, 2017 pending the determination of the application by High Court.

However, Buganda Road Court has heard that while in detention at Luzira women's prison, Dr. Nyanzi has been barred from reading any other written literature apart from the Bible.

Dr. Nyanzi's lawyer Mr. Nicholas Opio complained to presiding Chief Magistrate H/W James Ereemye that his client is being subjected to discriminatory treatment to the extent that she has been restricted to have hand written notes, books and or to have a private lawyer-client discussion.

In response, State Attorney Jonathan Muwaganya said that prison is a regulatory facility where literature for inmates is censored.

It's against this background that His Worship Ereemye ruled that he cannot pass judgment against prison authorities who are competent enough to do their work adding that since the concern has been raised, court should now await their feedback.

Prosecution alleges that on January 28, 2017 in Kampala District, Dr. Nyanzi used a computer to post on her Facebook page obscene or indecent comments against the President.

Dr. Stella Nyanzi has been remanded back to Luzira prison by the Buganda Road Court Magistrate James Ereemye due to an application Nyanzi made to high court.

The Makerere University researcher and activist made an application through her lawyer Mr. Isaac Kimaze Semakadde to High Court for revision of her case file and to determine if she her mental status should be examined.
